South Dakota Enacts Ban on Nearly All Abortions

With the only exception being to save the life of the expectant mother, South Dakota has banned all other abortions. Seeing that this ban directly opposes the Roe v. Wade decision of 1973, it is hard to imagine that a proposal, however noble or lofty as this, will be able to stand within the current legal system.

I sense more politics than power in Governor Mike Rounds’ decision.

PIERRE, S.D., March 6 — Gov. Mike Rounds (R) signed legislation Monday banning nearly all abortions in South Dakota, setting up a court fight aimed at challenging the 1973 Supreme Court decision that legalized abortion nationwide.

The bill would make it a crime for doctors to perform an abortion unless the procedure was necessary to save the woman’s life. It would make no exception for cases of rape or incest.

Planned Parenthood, which operates the state’s only abortion clinic, in Sioux Falls, has pledged to challenge the measure.

Rounds issued a written statement saying he expects the law to be tied up in court for years and not to take effect unless the Supreme Court upholds it.
